Terms of Use

1. Who you're agreeing with

These terms are an agreement between you and CHEN TING HAN, an individual developer in Japan ("we", "us"), who makes Ouch Now ("the app"). These terms apply to your purchase and use of the app. They are linked at checkout and shown when you first open the app, and you agree to them by buying or using the app after being shown them. If you don't agree, don't use the app.

2. Who sells the app

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. For help using the app itself, email us. Payments, taxes, billing and cancellations are covered by Paddle's Buyer Terms.

5. Plans, renewals and price changes

If you buy a subscription, it renews automatically at the end of each period until cancelled. You can cancel anytime from the link in your Paddle receipt email and keep access until the end of the paid period. Free trials, if offered, become paid at the end unless cancelled before then. We may change prices for future periods; existing subscribers are notified before the change applies (as described in Paddle's Buyer Terms) and can cancel before it does. Refunds follow our Refund Policy.

6. Calendars and other services

Connecting a calendar (Google Calendar, Outlook.com, and as they arrive Apple Calendar or a calendar link or file) is optional and also follows that service's own terms. Ouch Now only reads your calendars. Only add calendar links you're allowed to use; your employer's rules may apply to a work calendar. These services are run by other companies who may change, limit or stop them at any time; if that stops a feature from working, we'll try to restore it but can't promise to. Ouch Now is not made, endorsed or sponsored by Google, Microsoft or Apple.

7. Not a medical device, and not for critical reminders

Ouch Now is a productivity tool. It is not a medical device and does not diagnose, treat or replace care for ADHD or any other condition. Alerts can be missed (your Mac may be asleep, off, muted, or set to a different time; a calendar may not sync). Don't use Ouch Now for medication, medical, safety or other critical reminders. You stay responsible for your own appointments and tasks.

8. Service level and updates

We work to keep Ouch Now reliable, but we don't guarantee it will be uninterrupted, error-free, or work with every Mac or macOS version. We may release updates to fix problems or add features; some features may need the latest version of the app and macOS 14 or later. We may change or remove features; plans and ideas we share (on this site or elsewhere) are not promises. If a paid feature you bought is removed, contact us and we'll look for a fair solution.

9. Suspending or ending access

You can stop using the app anytime. We may suspend or end your license or access to paid features if you seriously or repeatedly break these terms, don't pay, or if there is a fraud or security risk (for example a refunded, charged-back or fraudulent purchase). Where reasonable, we'll tell you first and give you a chance to fix it.

10. No warranty

Apart from rights you have by law that can't be excluded, the app is provided "as is" and "as available", without warranties of any kind.

11. Limit of liability

Except where we act intentionally or with gross negligence, our liability to you is limited to ordinary, direct damage that actually occurred, up to the amount you paid for the app in the 12 months before the claim. This limit does not apply to damage caused by our intent or gross negligence, and it does not take away any right you have as a consumer that can't be limited by contract (including under Japan's Consumer Contract Act or the laws of your country). Because alerts can be missed (see section 7), please keep your own record of anything important.

12. Feedback

If you send ideas or suggestions, we may use them freely to improve Ouch Now, without owing you anything.

13. Law and disputes

These terms follow the laws of Japan. Courts in Japan have jurisdiction, except that if you are a consumer, you keep the protection of the laws of the country where you live and can bring claims there. Please contact us first; most problems are quick to solve.

14. Everything else

If part of these terms can't be enforced, the rest still applies. These terms, with the Privacy Policy, Refund Policy and Paddle's Buyer Terms, are the whole agreement about the app.

We may change these terms under Article 548-4 of Japan's Civil Code: only when the change is in users' general interest, or is reasonable and doesn't go against the purpose of these terms. Before a change takes effect, we'll post the new terms and the date they take effect on this page at least 14 days ahead (30 days for changes that reduce your rights), and mention it in the app's release notes.
